These terms are effective as of April 16, 2007.

General Terms

Welcome to Zollege. Zollege (collectively, "Zollege", "Zollege.com", "Nicholas Pettit", or "we") is an online tool that was created with the intention of helping college students effectively communicate messages to their local community. The site is currently unaffiliated with any corporate or legal entity. Zollege is loosely affiliated with Zoxide.com, its "parent" site. Both Zollege.com and Zoxide.com are currently operated and maintained by Nicholas Pettit, a Digital Media student at the University of Central Florida in Orlando, Florida. By accessing or using this web site at www.zollege.com, you (the visitor and/or member) signify that you have read, understand, and agree to be bound by the Terms of Service, regardless of whether or not you are a registered member of Zollege. If you do not agree to abide by these or any future Terms of Service, do not use or access (or continue to use or access) Zollege.

Eligibility

Zollege membership is restricted to persons under the age of thirteen (13). Any registration by persons under the age of 13 is strictly prohibited, unauthorized, and in violation of the Terms of Service. Zollege may terminate your account and delete any content or information that you have posted, for any reason, at any time, at our sole discretion, with or without notice, if we believe you are under the age of 13.

Zollege membership is also restricted to persons that do not have a valid email address, with the sole exception of Zollege administration accounts. Any registration by persons that do not have a valid email address, with the sole exception of Zollege administration accounts, is strictly prohibited, unauthorized, and in violation of the Terms of Service. Zollege may terminate your account and delete any content or information that you have posted, for any reason, at any time, at our sole discretion, with or without notice, if we believe that your account is not in connection with a valid email address.

Account Security

By creating and maintaining a Zollege account, you agree to provide accurate registration information, maintain the security of your password and identification, and accept full responsibility for any and all usage of your account.

Site Content and Copyrights

All content on www.zollege.com is the property of Zollege. With the exception of your own content and information, content on this site may not be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without prior written permission from Zollege. With the sole exception of your own content and information, you may not republish any content from this site on any Internet, Intranet, or Extranet site or include the information in any database or compilation, and any other use of Zollege content is strictly prohibited. Any unauthorized use may be in violation of applicable laws regarding copyright and communication regulations and statues. Nothing in these Terms of Service grant any kind of license to intellectual property rights and nothing in these Terms of Service shall be construed as conferring any license to intellectual property rights.

User Conduct

Zollege flyers are available for personal or commercial use. You agree that no content or information submitted through your account or otherwise posted by you through this site will infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights or contain unlawful material. You further agree not to harvest or collect email addresses or other contact information of members from Zollege by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications. Additionally, you agree not to use automated scripts to collect information from Zollege or for any other purpose. You further agree that you may not use Zollege in any unlawful manner or in any other manner that could damage, disable, overburden or impair Zollege.

Additionally, you may not post images, text, or any other content or information to Zollege that includes:

    • Violent content, racial intolerance, or advocacy against any individual, group, or organization
    • Pornography, adult, or mature content
    • Hacking/cracking content
    • Illicit drugs and drug paraphernalia
    • Excessive profanity
    • Gambling or casino-related content
    • Content regarding programs which compensate users for clicking on ads or offers, performing searches, surfing web sites, or reading emails
    • Sales or promotion of weapons or ammunition (e.g., firearms, fighting knives, stun guns)
    • Sales or promotion of beer or hard alcohol
    • Sales or promotion of tobacco or tobacco-related products
    • Sales or promotion of prescription drugs
    • Sales or promotion of products that are replicas or imitations of designer goods
    • Sales or distribution of term papers or student essays
    • Any other content that is illegal, promotes illegal activity, or infringes on the legal rights of others

Acceptable use is at the sole discretion of Zollege. Zollege may terminate your account and delete any content or information that you have posted, for any reason, at any time, at our sole discretion, with or without notice, if we believe that your account is linked to any activity or posting of content or information that is in violation of these Terms of Service.

Copyright Complaints

All copyright complaints should be submitted, in writing, info@zollege.com, and should be in accordance with the Digital Millennium Copyright Act (DMCA).

Repeat Offender Policy

In accordance with the Digital Millennium Copyright Act (DMCA), Zollege may terminate or "ban", in appropriate circumstances and at the sole discretion of Zollege, members or visitors that are deemed to be repeatedly violating the Terms of Service or the Privacy Policy, regardless of whether or not they are registered. Zollege may also terminate members and visitors that infringe on the intellectual property rights of others, whether or not there is any repeat violations.

Zollege may contain links to other web sites. Zollege is not responsible, in any way, for the content contained on web sites outside of this domain, www.zollege.com. These Terms of Service and our Privacy Policy are only applicable to this site, so we encourage visitors to read and understand the policies of other web sites and be aware of the information they collect.

User Interactions and Disputes

You are solely responsible for interactions of any kind, including, but not limited to, communications, transactions, trades, disputes, or otherwise, with other Zollege members, both online or offline. We reserve the right, but have no obligation, to monitor these interactions.

The privacy of our members and visitors is very important to Zollege. Click here to read the Zollege Privacy Policy. By using this web site, you agree to have your content and information transmitted and processed by remote services operated by companies or organizations unaffiliated with Zollege.

Zollege may be temporarily unavailable from time to time due to maintenance and other reasons. Zollege assumes no responsibility for errors, defects, delays, or failure of, member and visitor communications. These Terms of Service constitute the entire agreement between you and Zollege and shall supercede any previous agreement between you and Zollege of any kind made at any date. Failure of Zollege to adhere to these Terms of Service shall not constitute as a waiver of any kind. If any portion of these Terms of Service are held invalid, the remainder of these Terms of Service shall remain in full force and effect.

We reserve the right to make changes, additions, and deletions, at our sole discretion, to our Privacy Policy and our Terms of Service, at any time, without notification.
